H.C.R. NO. 27 - Summary

• Authorizes the Board of Land and Natural Resources to issue a 55-year non-exclusive easement covering approximately 535 square feet of state submerged lands at Kukuiula, Koloa, Kauai (Tax Map Key (4) 2-6-012).

• Easement permits maintenance and repair of an existing rock seawall and use of existing improvements constructed on the property owned by David G. Jorgensen and Annette Thatcher Jorgensen, Trustees of the David and Annette Jorgensen Revocable Trust.

• Resolves an encroachment issue that was identified and approved for resolution by the Board of Land and Natural Resources on December 12, 2014.

• Grantees must pay the State fair market value for the easement as determined by an independent appraisal.

• Requires prior approval of the Governor and legislative authorization under Hawaii Revised Statutes section 171-53 for disposition of state submerged lands.
