HI SB1125

Allows the Board of Land and Natural Resources to grant easements for less than fair market value for structures originally constructed landward of the shoreline within property boundaries but now located seaward of the certified shoreline due to natural shoreline movement.

Exempts special shoreline encroachment easements from requiring prior gubernatorial approval or legislative authorization, unlike other state submerged land easements.

Applies only to structures that were authorized by a governmental authority and legally constructed at the time, addressing situations where shoreline location has shifted naturally over time.

Easement grants must consider public policies for shoreline protection, preservation of natural shoreline, public pedestrian access, and long-term coastal hazard risks.

Takes effect retroactive to July 1, 2012.
