S.B. 2123 Summary

• Amends Hawaii Revised Statutes Section 46-4 to clarify that counties can distinguish between single-family residential use and single-family vacation rental use in zoning ordinances.

• Allows counties to adopt ordinances for amortization or phasing out of nonconforming single-family transient vacation rental units over a reasonable period of time in any zoning classification.

• Preserves existing protections by maintaining that amortization or phasing out of nonconforming uses does not apply to buildings or premises used for residential (single-family or duplex) or agricultural purposes.

• Makes technical correction by replacing "prior to" with "before" in reference to statutes in effect before July 1, 1957.

• Takes effect July 1, 2050.
