Repeals HRS § 291E-68, which made refusal to submit to breath, blood, or urine testing a petty misdemeanor offense.

Amends HRS § 291E-15 to remove reference to § 291E-68 and clarify that refusing to submit to testing subjects a person only to sanctions under part III or § 291E-65 (administrative revocation proceedings).

Maintains requirement that law enforcement officers inform arrested persons of sanctions and ask if they still refuse testing before imposing refusal consequences.

Preserves law enforcement officer's duty to provide notice under § 291E-41 or § 291E-65 regarding refusal sanctions.

Takes effect upon approval with no retroactive application to rights, penalties, or proceedings that occurred before enactment.
