Requires past performance on state, federal, or private contracts to be considered when evaluating bids and proposals for state procurement contracts.

Defines "past performance" to include recent and relevant contractor performance, legal actions, notices of deficiencies, and failure to complete contracts.

Mandates that departments evaluate and maintain records of contractor work and performance upon completion of procurement contracts.

Requires past performance review in sole source procurement determinations and establishes responsibility determination standards to be adopted by the policy board.

Appropriates funds for fiscal year 2016-2017 to the state procurement office for implementation; effective February 19, 2022.
