S.B. 2562 Summary

• Establishes a temporary state property cleanup program under the Department of Accounting and General Services to remove debris and litter from state real property after departure of persons who illegally camped or lodged there, operating from January 1, 2017 through December 31, 2018.

• Creates a temporary sheriff patrol program under the Department of Public Safety to enforce laws prohibiting trespassing, camping, and being present after closing hours on state real property, also operating from January 1, 2017 through December 31, 2018.

• Both temporary programs operate on a voluntary participation basis for state agencies (including the judiciary, but excluding the Office of Hawaiian Affairs) through memoranda of agreement, with no charges to participating agencies.

• Amends criminal trespass statutes by creating a new offense of "criminal trespass onto public real property" and modifying existing trespass provisions to allow law enforcement officers to request violators to leave based on posted signs, permit terms, or written statutes/rules.

• Appropriates funds for fiscal year 2016-2017 for planning, preparation, and implementation of both programs, with departments required to submit reports by 2018 recommending whether to extend, permanently establish, or terminate the programs.
