S.B. 2895 Summary

• Authorizes the Executive Director of the Hawaii Civil Rights Commission to dismiss a discrimination complaint and issue a notice of right to sue after finding reasonable cause and failing to secure a conciliation agreement within 180 days.

• Provides the Executive Director discretion to either demand that the respondent cease the unlawful discriminatory practice or dismiss the complaint for non-housing discrimination cases.

• Requires the Executive Director to demand cessation of unlawful discriminatory practices (without dismissal option) for complaints involving fair housing violations under chapter 515 and the federal Fair Housing Act.

• Allows the Commission to reconsider the Executive Director's determination to dismiss a complaint and issue a notice of right to sue on the Commission's own initiative, but prohibits judicial review of such decisions.

• Takes effect on July 1, 2091.
