Amends Section 378-3 of Hawaii Revised Statutes to clarify that employers, employment agencies, and labor organizations may refuse to hire, refer, or discharge individuals for reasons other than those protected under Hawaii's anti-discrimination law.

Replaces language limiting employer actions to those "relating to the ability of the individual to perform the work" with explicit reference to protected categories under sections 378-2, 378-2.3, 378-2.5, and 378-2.7.

Codifies that employers retain discretion to make employment decisions based on non-protected reasons while maintaining existing prohibitions against discrimination based on protected characteristics.

Effective date is July 1, 2091.
