HI HB1031

Authorizes the Child Support Enforcement Agency, Department of Taxation, Department of Human Services, and Department of Labor and Industrial Relations to conduct criminal history record checks on employees, prospective employees, and contractors who have access to federal tax information to comply with Internal Revenue Service requirements.

Requires these agencies to establish personnel security programs that include FBI fingerprint searches and criminal history record checks in accordance with section 846-2.7 of Hawaii Revised Statutes.

Permits agencies to terminate or deny employment, or refuse services from contractors, if background investigations reveal the person poses a risk to federal tax information security, with notice and opportunity to respond before termination.

Exempts these agencies from section 831-3.1 requirements and chapter 91 administrative procedures for conducting investigations, notifications, and hearings related to these background checks.

Adds four new authorized entities to the list in section 846-2.7 permitted to conduct criminal history record checks for federal tax information access purposes.
