H.B. 115 Summary

• Requires counties with populations of 500,000 or greater to take ownership and jurisdiction over disputed roads where ownership is unclear between state and county, or county and private parties.

• Defines "disputed road" as any highway, road, alley, street, way, lane, bikeway, bridge, or trail open to the public in qualifying counties where ownership and jurisdiction is in dispute.

• Transfers ownership of disputed roads to the county where no party has exercised ownership for five years prior to the effective date through an administrative order issued by the state director of transportation.

• Counties must accept all surrendered roads without discretion and immediately record ownership with the bureau of conveyances.

• Effective date: July 1, 2017.
