H.B. 1442 Summary

• Authorizes counties that established a surcharge on state tax prior to July 1, 2015 to extend the surcharge in perpetuity instead of the previous December 31, 2027 expiration date.

• Authorizes counties that have not established a surcharge on state tax by July 1, 2017 to establish a new surcharge on state tax at rates specified in sections 237-8.6 and 238-2.6, with levying to begin January 1, 2018.

• Changes payment frequency of county surcharge proceeds from the state treasury from quarterly to monthly basis within ten working days after collection.

• Requires ten percent of gross county surcharge proceeds to be retained by the state and used by the Department of Transportation instead of being classified as general fund realizations.

• Removes the December 31, 2027 repeal date for Act 247, Session Laws of Hawaii 2005, allowing the county surcharge authority to continue indefinitely.
