Amends Hawaii Revised Statutes Section 167-5 to clarify that the Board of Agriculture can acquire property by eminent domain for water facilities conveying water for "other agricultural uses" instead of "domestic use."

Modifies the definition of "public utility" in Section 269-1 to exclude entities operating irrigation projects or facilities that convey, distribute, and transmit nonpotable water pursuant to Chapter 167.

Removes irrigation projects and nonpotable water operations from Public Utilities Commission regulatory oversight.

Effective date: January 7, 2059.
