HB 243 Summary

• Repeals chapter 514A (Hawaii Revised Statutes) governing condominium property regimes created before July 1, 2006, consolidating all condominium regulation under chapter 514B.

• Makes chapter 514B applicable to all condominiums in Hawaii, provided such application does not invalidate existing provisions of condominium documents or infringe on a developer's reserved rights.

• Requires developers of chapter 514A projects not yet brought to market to register under chapter 514B and bring projects to market by January 1, 2019.

• Removes all references to chapter 514A throughout Hawaii Revised Statutes (affecting sections in chapters 26, 92, 205, 235, 237, 281, 302A, 378, 414D, 421I, 467, 484, 485A, 501, 502, 502C, 514B, 514C, 514E, 516D, 521, 634, 667, and 672E).

• Takes effect January 1, 2019, eliminating confusion by maintaining only one condominium chapter while preserving developer rights and existing contractual obligations.
