Amends Hawaii law to prohibit the director of corrections from transferring inmates to private correctional institutions in other states, limiting transfers only to facilities operated by the federal government, states, or their political subdivisions.

Removes authorization for the governor to negotiate with private institutions for the development of out-of-state Hawaii correctional facilities, limiting negotiations to federal government or state jurisdictions.

Restricts the governor's contracting authority for correctional facility construction to facilities located within the State of Hawaii only, eliminating the ability to construct facilities in other states.

Clarifies that the State may still enter into agreements with federal and state governments to house inmates and develop correctional facilities to address prison overcrowding.

Takes effect upon approval and does not affect rights, penalties, or proceedings that existed before the law's effective date.
