Creates new offense of resisting arrest in the first degree as a class C felony, specifically for intentionally using or attempting to use force to remove a firearm from a law enforcement officer during an arrest.

Defines "firearm" according to section 134-1 of Hawaii Revised Statutes for purposes of the new offense.

Reclassifies existing resisting arrest offense as resisting arrest in the second degree, maintaining misdemeanor status for preventing arrest through physical force or threats that create substantial risk of bodily injury.

Does not affect rights, duties, penalties, or proceedings that were established before the effective date.

Effective January 7, 2059.
