Requires the Department of Health to develop guidelines determining when disclosure of a cesspool's existence is mandatory prior to sale or transfer of real property.

Establishes that if the Department of Health determines cesspool disclosure is mandatory under its guidelines, the cesspool's existence must be treated as a material fact in seller's disclosure statements.

Applies these disclosure requirements to real property transactions covered under Chapter 508D, Hawaii Revised Statutes.

Takes effect upon approval and does not affect rights, duties, or proceedings that existed before the effective date.
