HB 793 Summary

• Requires places of public accommodation with at least 100 parking spaces to designate at least one parking space per 100 spaces exclusively for electric vehicles equipped with charging systems.

• Removes previous provision allowing owners of multiple parking facilities to meet requirements in aggregate across different properties; each property must now comply individually.

• Establishes enforcement procedures: Department of Transportation must issue written notification of noncompliance, followed by a first warning within 365 days, formal notice of violation within 180 days, and fines of $200 per day of noncompliance; liens may be placed on property if fines exceed $300,000.

• Allows the Department of Transportation to exempt places of accommodation from compliance in cases of financial or engineering hardship, unless charging stations can be installed at no cost.

• Creates a two-year task force appointed by the Director of Transportation to examine and recommend expansion of electric vehicle parking spaces in public parking lots, with preliminary report due before 2018 legislative session and final report due before 2019 legislative session.
