Department of Health must develop guidelines to determine when disclosure of cesspools is mandatory prior to sale or transfer of real property.

If cesspool disclosure is determined mandatory under DOH guidelines, the cesspool's existence becomes a material fact that must be included in a seller's disclosure statement.

The Act does not affect rights, duties, penalties, or proceedings that began before its effective date.

The Act takes effect upon approval.
