HI SB261

Prohibits smoking in a motor vehicle when a person under age 18 is present, with violations subject to a $100 fine.

Defines "smoke" using the same meaning as provided in section 328J-1 of Hawaii Revised Statutes.

Amends section 291C-161 to include the new smoking prohibition in the list of motor vehicle violations subject to sentencing or fines.

Requires the department of health to submit a report to the legislature by twenty days prior to the 2019 regular session regarding enforceability and coordination of data collection efforts among law enforcement agencies.

Takes effect upon approval and does not affect rights, duties, or proceedings that existed before the effective date.
