S.B. 674 Summary

• Creates a new chapter establishing statewide eyewitness identification procedures for law enforcement agencies in Hawaii.

• Requires law enforcement to inform eyewitnesses that the suspect may or may not be in the identification procedure, that the administrator may not know the suspect's identity, and that investigations will continue regardless of identification outcome.

• Prohibits contaminating eyewitness identifications through use of distinctive suspect clothing, display of suspects in handcuffs, or suggestive procedures by law enforcement.

• Mandates use of photo or live lineups with minimum numbers of fillers (5 for photo lineups, 4 for live lineups) whenever reasonably practicable; restricts showups to exigent circumstances with blind or blinded administrators and written documentation of necessity.

• Directs the attorney general to establish uniform statewide procedures and protocols for eyewitness identification procedures across all counties; effective January 7, 2059.
