S.B. 797 Summary

• Creates a new misdemeanor offense of criminal property damage to a public restroom for intentionally or knowingly damaging toilets, urinals, bathroom stalls, mirrors, or sinks to render them unusable.

• Defines a public restroom as any restroom or comfort station located at a public park or recreational ground as defined in section 708-814.5.

• Establishes mandatory minimum penalties including a minimum fine and minimum term of imprisonment not exceeding the maximum term under section 706-663, notwithstanding existing sentencing provisions.

• Responds to documented instances of vandalism at public restroom facilities in parks across the state, which costs taxpayers money and prevents public use and enjoyment of parks.

• Takes effect January 7, 2059.
