Department of Health requested to update Hawaii Administrative Rules for underground storage tanks to match EPA regulations codified in 40 CFR Part 280, effective October 13, 2015.

Field-constructed underground storage tanks with capacity over 50,000 gallons installed before July 15, 2015 must comply with federal upgrade requirements or equivalent standards, with phased upgrades permitted until September 28, 2037.

Existing tanks must be subject to release detection requirements per 40 CFR Part 280 and monitored using methods authorized under Hawaii Administrative Rules chapter 11-281 prior to upgrading with secondary containment.

Construction or installation of new field-constructed underground storage tanks prohibited after July 1, 2017 unless equipped with secondary containment or superior standards and full compliance with chapter 11-281 requirements.

Resolution responds to January 2014 fuel release from Red Hill facility and an Administrative Order on Consent between EPA, Department of Health, U.S. Navy, and Defense Logistics Agency requiring federal regulatory compliance.
