HI HB1120

Creates a new category of "special shoreline encroachment" for structures authorized by government agencies and originally constructed landward of the shoreline within property boundaries but now located seaward of the shoreline on public land due to shoreline migration.

Allows the Board of Land and Natural Resources to grant easements for these structures at a value determined by the board, rather than requiring compensation at fair market value as typically mandated under sections 171-13 and 171-17(b).

Exempts special shoreline encroachment easements from requiring prior approval of the governor and prior authorization of the legislature, consistent with existing exemptions for moorings, cables, and pipelines.

Requires that easements granted under this provision consider public policies protecting the natural shoreline, preserving public pedestrian access, and addressing long-term risks from coastal hazards.

Takes effect retroactively upon approval to July 1, 2012.
