H.B. 1358 Summary

• Decriminalizes possession and distribution of up to one ounce of marijuana or marijuana concentrate for personal use by adults age 21 and older.

• Permits cultivation of up to 10 marijuana plants (with no more than 5 mature, flowering plants) on residential property in an enclosed, locked space for personal use, and prohibits sale of such plants.

• Allows transfer or transport of one ounce or less of marijuana to another adult age 21 or older without criminal prosecution, regardless of payment.

• Creates an affirmative defense to marijuana-related criminal charges for possession or distribution of marijuana for personal use, except when involving minors.

• Exempts marijuana for personal use from the definition of "detrimental drug" and "harmful drug" under existing drug statutes, and protects all vehicle occupants from prosecution when marijuana for personal use is found in a motor vehicle.
