HI HB16

Creates new offense of urinating or defecating in public, defined as intentionally or knowingly engaging in these acts in a public place or where likely to be observed by the public.

Defines "public place" to include streets, sidewalks, driveways, alleys, doorways, malls, plazas, parks, public buildings, and parking lots.

Exempts persons with documented medical conditions verified by a licensed physician and persons using appropriate restroom or toilet facilities.

Establishes graduated penalties: first offense up to $1,000 fine, second offense up to $2,000 fine, third or subsequent offense up to $5,000 fine.

Takes effect upon approval and does not affect proceedings or penalties that occurred before the effective date.
