HB1806 Summary

• Requires the Department of Health to educate food establishments about liability protections for food donors during health inspections and distribute materials explaining exceptions to liability under chapter 145D.

• Expands liability protection to allow donors to give food directly to needy persons or through charitable, religious, nonprofit, or government organizations without civil or criminal liability except for gross negligence or wanton acts.

• Authorizes donation of perishable and nonperishable food that has exceeded the manufacturer's labeled shelf life date when the donor reasonably believes in good faith that the food remains fit for human consumption.

• Allows donation of farm produce, including situations where needy persons directly participate in harvesting, provided the donor or distributing organization believes in good faith the food is safe for human consumption.

• Amends section 663-10.6 to clarify that donors of goods, materials, or services are exempt from civil liability for injuries resulting from donations except for gross negligence or wanton acts or omissions.
