HB1994 Summary

• Creates the "Ho'okipa Welcoming Policy Act" establishing restrictions on Hawaii law enforcement agencies' cooperation with federal immigration enforcement by the Department of Homeland Security's ICE and CBP.

• Prohibits state and local law enforcement from stopping, questioning, or arresting individuals based solely on immigration status or civil immigration detainers, except when accompanied by a judicial warrant signed by a federal judge.

• Allows limited detention (up to 48 hours) on civil immigration detainers only for individuals convicted of felonies, certain specified misdemeanors within prior five years, those with probable cause for felony arrests, terrorists, illegal re-entrants, or registered sex offenders under Hawaii law.

• Restricts law enforcement from sharing non-public information (release dates, addresses) with immigration authorities except in the same limited circumstances, and requires providing detainer copies to affected individuals before responding to federal requests.

• Requires semi-annual reporting to Hawaii's Attorney General with aggregated, de-identified data on all immigration detainers and requests received, with reports made public; effective date July 1, 2050.
