H.B. 2016 Summary

• Prohibits counties from imposing inclusionary zoning requirements on housing developments offered exclusively for sale to buyers earning less than 140 percent of the area median income.

• Prohibits counties from imposing exactions (conditions requiring land dedication, infrastructure building, or fee payments) on housing developments offered exclusively for sale to buyers earning less than 140 percent of the area median income.

• Defines "exaction" as a condition on a land use permit requiring developers to fulfill requirements beyond zoning ordinances, including land dedication, infrastructure construction, or fee payments to mitigate development impacts.

• Defines "inclusionary zoning requirement" as any requirement to set aside a portion of a housing development for sale at below-market prices.

• Sunsets on June 30, 2023, with section 46-4 of Hawaii Revised Statutes reverting to its form as of June 30, 2018; effective date is July 1, 2018.
