• Authorizes counties to adopt ordinances legalizing cannabis cultivation, possession, sale, transfer, and use for persons over age 21, whether for personal, commercial, or medicinal purposes.

• County ordinances legalizing cannabis must supersede state statutes prohibiting cannabis (HRS Chapter 329 Part IX and Chapter 712 Part IV) and are not recognized in counties that have not adopted similar ordinances.

• Counties adopting legalization ordinances must adopt administrative rules under HRS Chapter 91 to regulate cannabis activities; ordinances do not become effective until rules are adopted.

• Clarifies that cannabis-related offenses under state law do not apply in counties that have adopted legalization ordinances and accompanying administrative rules.

• Does not affect rights, duties, penalties, or proceedings that occurred before county ordinances and rules take effect.
