Prohibits discrimination based on sex, gender identity or expression, and sexual orientation in any state educational program or activity, or in any educational program or activity receiving state financial assistance.

Creates a state-level corollary to federal Title IX protections that applies regardless of whether a program also receives federal funds.

Allows students to bring civil actions for sexual harassment, sexual assault, infliction of emotional distress, or invasion of privacy, with the Hawaii Civil Rights Commission required to issue a notice of right to sue if similar facts are filed in circuit court.

Applies to educational programs operated by the University of Hawaii, Department of Education, and public charter schools, as well as any other educational programs receiving state financial assistance.

Takes effect on July 1, 2025.
