• Clarifies the definition of "practice of behavior analysis" to include design, implementation, and evaluation of instructional and environmental modifications; functional assessment and analysis; and use of behavioral techniques to develop or modify behaviors.

• Allows individuals supervised by licensed professionals (such as paraprofessionals, students, and parents) whose scope of practice overlaps with behavior analysis to provide services without licensure as behavior analysts.

• Expands exemptions from licensure to include individuals with board certification from the Behavior Analyst Certification Board or Behavioral Intervention Certification Council working under supervision of a licensed professional.

• Permits caregivers and family members to implement applied behavior analysis plans under direction of a licensed behavior analyst or licensed professional authorized to practice behavioral analysis.

• Clarifies that behavioral techniques used solely as treatment modalities are excluded from the practice of behavior analysis requiring licensure.
