• Clarifies and standardizes terminology related to behavior analysis and applied behavior analysis practices in Hawaii law.

• Expands licensing exemptions under Chapter 465D to allow licensed psychologists and their supervisees, classroom teachers, and caregivers in developmental disabilities waiver programs to provide applied behavior analysis services within their scope of practice without licensure as behavior analysts.

• Permits direct support workers providing services under the Medicaid home and community-based services waiver (section 1915(c) of the Social Security Act) to implement applied behavior analysis programs under supervision of a licensed behavior analyst or psychologist through January 1, 2024.

• Requires the Department of Education to develop and implement a plan to seek Medicaid reimbursement for applied behavior analysis services provided to students diagnosed with autism spectrum disorder.

• Mandates the Department of Education submit an initial report within 90 days and quarterly reports thereafter detailing student numbers, staffing needs, Medicaid reimbursement, and implementation progress.
