HB2341 Summary

• Amends Act 263, Session Laws of Hawaii 2016 to expand the Employees' Retirement System's (ERS) authority to process qualified domestic relations orders in divorce proceedings.

• Extends qualified domestic relations order provisions to cover former ERS members with vested benefit status, in addition to current members and retirants.

• Allows ERS to make direct payments to spouses or former spouses who have been awarded a portion of ERS retirement benefits through court-ordered domestic relations orders.

• Delays implementation of Act 263, SLH 2016 from July 1, 2018 to July 1, 2020.

• Establishes procedures for submitting, reviewing, and determining qualified domestic relations orders, including filing fees and charges for legal and actuarial services.
