HB 2357 Summary

• Establishes eviction procedures for Hawaii Public Housing Authority's state low-income housing projects and elder or elderly housing programs.

• Creates grounds for lease termination including failure to pay rent, lease violations, rule violations, failure to maintain habitable conditions, third drug-related violation, or other circumstances giving authority immediate right to possession.

• Requires written notice to tenants of violations and right to a contested case hearing before an eviction board consisting of 2-3 members including at least one tenant representative.

• Allows tenants 10 business days to cure curable violations after eviction board decision; only non-cured violations result in issuance of writ of possession.

• Permits judicial review of eviction decisions in circuit court within 30 days and establishes appeal rights to appellate courts under Hawaii Revised Statutes chapter 602.
