Amends the definition of "drug" in Hawaii Revised Statutes Chapter 291E (vehicle intoxication offenses) to include two categories: controlled substances listed in schedules I through IV of Chapter 329, and non-controlled psychoactive chemical substances that alter brain function and change perception, consciousness, or behavior (excluding caffeine and nicotine).

Expands law enforcement's ability to prosecute driving under the influence cases involving emerging synthetic drugs like "spice" and "bath salts" that can evade traditional controlled substance scheduling processes.

Does not affect rights, duties, penalties, or proceedings that occurred before the effective date.

Effective date: July 1, 2035.
