HB 2588 Summary

• Authorizes courts to impose an extended term of imprisonment for offenders convicted of negligent homicide in the first degree under Hawaii Revised Statutes section 707-702.5 who do not remain at the scene and render reasonable assistance to injured persons.

• Adds a new criterion (subsection 7) to section 706-662 allowing extended sentencing when a defendant fails to remain at the scene or provide assistance, including violations of section 291C-12.

• Named "Kaulana's Law" in response to the April 24, 2016 death of 19-year-old Kaulana Matthew Auwae Werner, who was struck by a vehicle whose driver fled the scene.

• Requires proof beyond a reasonable doubt that an extended term is necessary for public protection before courts may impose the extended sentence.

• Effective upon approval with no retroactive application to rights, duties, penalties, or proceedings that matured or began before the Act's effective date.
