HB2641 Summary

• Establishes a ten-year redevelopment district pilot project for the Kanoelehua Industrial Area and Banyan Drive region in Hawaii County, operating until June 30, 2028.

• Creates a nine-member planning committee with two ex-officio members (board chairperson and county planning director) and seven public members appointed by the governor, all from Hawaii County, to oversee redevelopment planning and implementation.

• Grants the planning committee authority to renew leases, reduce or waive rental payments up to one year for substantial improvements, approve redevelopment agreements, and prepare comprehensive redevelopment plans with district-wide improvements.

• Modifies Hawaii Revised Statutes Section 171-36 to allow lease extensions up to 39 additional years for hotel, resort, and industrial leases upon board approval of development agreements for substantial improvements, and increases extension limits for hardship cases.

• Appropriates funds from the special land and development fund for fiscal year 2018-2019 to carry out the purposes of the act; committee and all powers dissolve on June 30, 2028, with remaining leases and contracts transferred to the Department of Land and Natural Resources.
