Amends Section 353-16.2 to limit inmate transfers to out-of-state correctional institutions operated by the federal government, state governments, or political subdivisions, eliminating the option to transfer to private institutions.

Modifies Section 353-16.3 to authorize the governor to negotiate with the federal government or state governments (rather than "out-of-state jurisdictions") for development of Hawaii correctional facilities to reduce overcrowding, subject to legislative approval by concurrent resolution.

Amends Section 353-16.36 to clarify that private entity contracts for constructing and leasing or purchasing correctional facilities must be located within the State of Hawaii only.

Prohibits Hawaii from contracting with out-of-state private correctional facilities while permitting contracts with federal, state, and municipal government entities.
