H.B. 538 Summary

• Establishes the intellectual and developmental disabilities medicaid waiver administrative claiming special fund under Chapter 333F, Hawaii Revised Statutes, to receive federal Medicaid administrative claiming revenues and legislative appropriations.

• Fund moneys may be used for fiscal management services, staff and provider training, quality management activities, information technology system operations, rate methodology studies, and participant assessment services related to the Section 1915(c) Home and Community-Based Services waiver.

• Requires the Department of Health to submit annual reports to the legislature accounting for fund receipts and expenditures no later than 20 days before each regular session.

• Creates a working group chaired by the State Council on Developmental Disabilities to examine the waiver application process and existing services, with findings due to the legislature by 20 days before the 2019 regular session.

• Exempts the new special fund from the 5% central service assessment and pro rata administrative expense sharing requirements applied to other special funds under Sections 36-27 and 36-30.
