HI HB61

Prohibits smoking in any motor vehicle when a person under age 18 is present in the vehicle.

Defines "smoke" using the same meaning provided in section 328J-1 of Hawaii Revised Statutes.

Establishes a $100 fine for violation of the smoking prohibition.

Requires the Department of Health to report to the legislature by twenty days before the 2018 regular session on enforceability by law enforcement as a secondary offense and coordination of data collection among agencies.

Takes effect upon approval and does not affect rights, duties, or proceedings that began before the effective date.
