HI SB21

Increases civil penalties for violations of child care laws from up to $1,000 (first violation) and $3,000 (subsequent violations) to up to $5,000 (first violation) and $10,000 (subsequent violations) for violations of Part VIII of Chapter 346.

Authorizes the Department of Human Services to refer intentional, knowing, or reckless violations of Part VIII child care regulations or health and safety rules to the Attorney General or county police department for potential criminal prosecution.

Clarifies language in the penalty statute to specify "who violates" rather than "violating any provision of" and updates references to "rules adopted pursuant to this chapter."

Does not apply retroactively to violations that occurred, penalties incurred, or proceedings begun before the effective date.

Takes effect January 7, 2090.
