S.B. 2304 Summary

• Prohibits issuance of new retail tobacco permits beginning November 1, 2018, for businesses located within 500 feet of preschools, schools, or public playgrounds, measured from the boundary of the facility to the boundary of the business premises.

• Allows existing retail tobacco permits issued before November 1, 2018, to be renewed regardless of proximity to schools or playgrounds.

• Beginning December 1, 2051, prohibits the sale of tobacco products and electronic smoking devices at any business location within 500 feet of preschools, schools, or public playgrounds.

• Establishes grounds for the Department of Taxation to suspend, revoke, or decline to renew retail tobacco permits for violations including false applications, fraud, noncompliance with tobacco laws, and sales to minors.

• Penalties for violations include $500 fine for first offense and $500 to $2,000 for subsequent offenses, with each day of violation constituting a separate offense.
