SB 2373 Summary

• Amends Hawaii Revised Statutes Section 89-9(d) to permit negotiations over the implementation of management decisions that affect terms and conditions of employment subject to collective bargaining.

• Allows negotiations over procedures and criteria for promotions, transfers, assignments, demotions, layoffs, suspensions, terminations, discharges, and other disciplinary actions as subjects of bargaining.

• Clarifies that neither party is compelled to agree to proposals or make concessions during negotiations over such procedures and criteria.

• Permits violations of negotiated procedures and criteria to be subject to the grievance procedure in collective bargaining agreements.

• Effective date: January 1, 2050.
