S.B. 2447 Summary

• Amends section 604A-2 of Hawaii Revised Statutes to clarify the jurisdiction of environmental courts under chapters 6D, 6E, 6K, 128D, 339, 339D, 340A, 340E, 342B, 342C, 342D, 342E, 342F, 342G, 342H, 342I, 342J, 342L, 342P, 343, and 508C, and title 12.

• Exempts all proceedings relating to motor vehicle, motorcycle, motor scooter, or moped parking violations from the exclusive, original jurisdiction of environmental courts.

• Allows the chief justice to assign environmental law issues to the environmental courts upon motion of a party or sua sponte when assignment is needed to ensure uniform application of environmental laws throughout the State.

• Preserves all rights, duties, penalties, and proceedings that were initiated before the effective date.

• Takes effect on July 1, 2035.
