SB2705 Summary

• Establishes an Office of Public-Private Partnership within the Department of Accounting and General Services, headed by a Public-Private Partnership Coordinator exempt from civil service requirements.

• Authorizes public-private partnership project delivery methods for construction projects, allowing state and county agencies to contract for any combination of design-build, financing, maintenance, or operation of infrastructure facilities over a defined period.

• Requires public-private partnership procurements to include prequalification of offerors to a short list of no more than three, stipulates evaluation criteria (design compliance, qualifications, financial capacity, schedule, price, and other factors), and allows negotiation with the highest-ranked offeror on statement of work and contract terms.

• Mandates that projects with contract price exceeding $10,000,000 or operations/maintenance periods of at least ten years include qualified independent peer reviewer services as an evaluation factor, and requires gubernatorial or mayoral approval before proceeding.

• Appropriates funds for fiscal year 2018-2019 to establish and operate the office and fund a Public-Private Partnership Coordinator position and one additional staff position.
