S.B. 2719 Summary

• Extends the civil statute of limitations for sexual abuse claims by minors to eight years after the victim's eighteenth birthday or three years after discovering the injury was caused by sexual abuse, whichever is later.

• Creates an eight-year window (from April 24, 2012) allowing victims of child sexual abuse to file otherwise time-barred civil claims against the perpetrator or responsible entities.

• Permits claims against legal entities if the abuser was employed by them with a duty of care to the victim, or if the entity had responsibility or control over the activity in which abuse occurred.

• Limits damages against legal entities to cases where gross negligence is found.

• Takes effect July 1, 2018, and applies retroactively to April 24, 2012.
