Expands eligibility for expungement orders to include persons involuntarily hospitalized under section 706-607 and persons acquitted or having charges dismissed due to physical or mental disease, disorder, or defect under chapter 704.

Modifies section 831-3.2(a)(4) of Hawaii Revised Statutes to clarify that expungement orders shall not be issued for defendants meeting these mental health-related criteria.

Amends section 846-9 to remove dissemination limitations for criminal history records relating to acquittals, dismissed charges, or involuntary hospitalizations based on physical or mental disease, disorder, or defect, allowing broader access to such information.

Allows public and noncriminal justice agencies to access criminal history records for cases involving mental health-related acquittals or hospitalizations, whereas such records were previously restricted to criminal justice agencies only.

Effective date: July 1, 2018.
