S.B. 2749 Summary

• Amends child support guidelines to require courts to use "shall" instead of "may" when considering factors including all earnings, income, other evidence of ability to pay, and resources of both parents.

• Expands guideline considerations to include health care needs through private or public coverage and cash medical support, and adds specific criteria for imputing income including age of child, assets, employment history, education, health, criminal record, and local job market conditions.

• Establishes a guidelines reviewing committee to review and revise guidelines at least every four years, with requirements to analyze economic data, labor market data, case data on guideline applications and deviations, and provide meaningful public input opportunities including from low-income parents.

• Requires publication of all guidelines reviewing committee reports, membership, guidelines, and review dates on the Internet and makes them publicly accessible through the family court.

• Appropriates unspecified funds to the Child Support Enforcement Agency for fiscal year 2018-2019 to collect data for the quadrennial guidelines review; effective date is July 1, 2035.
