SB 2786 Summary

• Creates new section 356D authorizing Hawaii Public Housing Authority to designate certain housing project areas as closed to the public with "Closed to the Public – No Trespassing" signs meeting specific requirements: letters at least two inches high and placement at intervals of no less than three signs per mile along boundaries and all entrances.

• Amends section 708-814 (Criminal Trespass in the Second Degree) to criminalize unlawful entry or remaining in closed housing project areas that comply with signage requirements, or entry after written warning from housing authority or law enforcement based on alleged law or rule violation.

• Establishes that written trespass warnings must be issued within one year of incident and contain the violator's legal name, aliases, photograph or physical description, warning giver's name and credentials, date/time of warning, and signatures of warning giver and witness or law enforcement officer.

• Clarifies that tenant authorization or invitation to enter housing project areas does not permit unauthorized individuals to remain in areas closed to the public.

• Takes effect July 1, 2035.
