S.B. 2800 Summary

• Amends Hawaii Revised Statutes Chapter 338 to allow the Department of Health to disclose vital statistics records to its own employees for approved research purposes with institutional review committee authorization.

• Permits disclosure of names, addresses, and contact information to employees for contacting individuals to request informed consent for use of additional specified information in records.

• Allows disclosure of information without informed consent if the institutional review committee determines that obtaining consent is impracticable and that a public health purpose substantially outweighs confidentiality interests.

• Restricts redisclosure of information to cases where the institutional review committee authorizes it or where records have been redacted of all identifying personal information.

• Takes effect on July 1, 3000.
